Freelancer Service Agreement

The terms that apply to freelancers offering services on Xwork. Read together with the Terms of Service and User Agreement.

1. Independent contractor

As a freelancer you are an independent contractor, not an employee, agent or partner of Xwork. You control how, when and where you perform your services, and you are responsible for your own equipment, expenses, insurance and taxes.

2. Eligibility & verification

You must be at least 18, provide accurate profile information, and complete identity verification before your earnings can be paid out (see our AML & KYC Policy). Each person may operate only one freelancer account unless we permit otherwise.

3. Proposals & contracts

Applying to jobs is free. When a client hires you, a contract is formed on the terms you both accept. Deliver the agreed work honestly and on time, communicate through Xwork, and only submit work you have the right to provide.

4. Getting paid & fees

Fixed-price work is funded into escrow and released to you as milestones are approved. Xwork charges a service fee on your earnings — 10% on the standard plan, or 5% with a Pro membership — deducted at the time a payment is processed. Released funds clear after a short security-hold period, then become available to withdraw to your connected payout method.

5. Taxes

You are solely responsible for determining and paying any taxes on your earnings and for any tax reporting required where you live or work. Keep your tax information on file up to date to avoid payout delays.

6. Ownership of work

Unless your contract says otherwise, ownership of deliverables transfers to the client on full payment. Don't reuse a client's confidential materials beyond what the contract allows.

7. Conduct & account standing

Follow the Community Guidelines and Acceptable Use Policy. Circumventing fees or escrow, misrepresenting your identity or skills, or abusing clients can lead to warnings, feature limits, suspension or permanent closure.
